This is part of an email that I sent to a Paralegal at my workplace:
….
This training exercise is completely optional, it’s something that would need to be done outside work time as it would be unofficial training.
My idea for a training exercise would be to watch the submissions before the ICJ in:
South Africa v Israel
south africa v israel icj israel – Search Videosbing.com
and the submissions in:
Defense for Children International – Palestine v Biden
https://www.uscourts.gov/cameras-courts/defense-children-international-palestine-v-biden
Given that the submissions are quite lengthy, it might be more practical to listen to parts of them rather than listening to every word.
I suspect that there will be an overlap in answers but I’d suggest the following as possible discussion questions:
1. What are your thoughts about the tactics used by the parties?
2. What are your thoughts about the way that the submissions were structured?
3. Compare and contrast some or all of the submissions.
4. When advocates made little mistakes in their submissions, and acknowledged them, how well did they do in rectifying their error?
5. What are your views on the judgments?
6. What can you learn from some or all of these submissions that would assist before attending Court as an advocate in a PI claim?
After considering these discussion points, I’d suggest drafting notes, possibly in bullet point form, summarising your responses to these questions. The notes should ideally be no longer than 2 pages of A4 (and if possible 1 page).
The final stage of the training would be to prepare a presentation lasting no longer than 10 minutes (if possible) summarising the cases and giving your opinion about them (the notes regarding the discussion questions could effectively write most of the presentation).
What are your thoughts about this as a training exercise? How could it be improved?
Thanks
Pete

LPHR publishes landmark independent legal opinion by eminent team of experts that finds the closure of Gaza, including its intensification since 7 October 2023, to constitute the crime
against humanity of persecution
Today, the UK legal charity, Lawyers for Palestinian Human Rights (LPHR), publishes a landmark independent legal opinion by an eminent team of legal experts that finds the closure of Gaza since 2007, including its intensification since 7 October 2023, to constitute the crime against humanity of persecution committed against Gaza’s Palestinian population, including over 1 million children.
The defining features of this crime – considered the quintessential crime against humanity – are (i) there has been a severe deprivation of fundamental human rights, and (ii) this harmful deprivation is discriminatory against a protected group. The crime of persecution concurrently reduces a person to their membership in or identification with a protected group, and attacks the group itself.
Four specialist international criminal and human rights law practitioners and/or academics – Juan Mendez, Megan Hirst, Nikila Kaushik and Lauren Tipton1 – with no background on Palestine/Israel, were instructed in 2021 by LPHR to prepare an intentionally technical legal opinion that specifically assesses whether or not the closure of Gaza constitutes the crime against humanity of persecution.
LPHR asked that the legal opinion address all possible justifications for the closure of Gaza. The work was undertaken on the basis that full payment be made irrespective of its legal conclusions.
The 210-page legal opinion was completed in two phases: a 159-page legal opinion (completed 5th December 2022) on the closure of Gaza since 2007, and a 51-page addendum (completed 16th January 2024) to the legal opinion that covers the intensified closure of Gaza since 7 October 2023. Together they provide vital and ample legal clarity for accountability and policy decision-makers.
The initial 159-page legal opinion finds that “despite contributions from others, the closure is overwhelmingly implemented by Israel.” Applying the law relevant for cases brought before the International Criminal Court (ICC) or under universal jurisdiction – and using the appropriate standard of proof adopted by the ICC in deciding whether to investigate – it concludes:
“480. Based on the above analysis, we have concluded that there is a reasonable basis to believe that the closure constitutes the crime against humanity of persecution.
1 Juan Mendez is the former UN Special Rapporteur on Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment (2010-16). He has also previously been Special Advisor to the ICC Prosecutor, Special Advisor to the UN Secretary-General on the Prevention of Genocide, Co-Chair of the International Bar Association Human Rights Institute, and President of the International Centre for Transitional Justice. He is currently Professor of Human Rights Law at Washington College of Law and an Academic Expert at Doughty Street Chambers.
Megan Hirst is a barrister at Doughty Street Chambers. She is the former International Civil Party Lead Co-Lawyer at the Extraordinary Chambers in the Courts of Cambodia and has represented victims in several proceedings before the ICC. Nikila Kaushik has recently been an associate lecturer at the University of Sydney and previously worked at the Extraordinary Chambers in the Courts of Cambodia and the ICC. She is undertaking pupillage at Doughty Street Chambers. Lauren Tipton is a legal consultant who has worked with the International Criminal Tribunal for Rwanda, the Special Court for Sierra Leone, and the Extraordinary Chambers in the Courts of Cambodia.

Nearly 10% of patients with autoimmune rheumatic disease experience flares following COVID-19 vaccination, according to data published in Rheumatology.

Coronavirus disease is a highly infectious viral disease caused by severe acute respiratory syndrome virus (SARS nCoV2). It was declared a pandemic within a few months of identification of its index case. The spread of COVID-19 across the globe was rampant, overwhelming healthcare systems and crippling global economies. Since the world was caught off guard by the pandemic, vaccine programs had to be rolled out in emergency to curb its spread. Ten vaccines have been granted Emergency Use Authorization thus far. Much of the side effects we know today are post-marketing adverse effects. Most of them are mild like myalgia and injection-site reactions, but a few of them such as post-vaccination autoimmune diseases have alerted the medical community. These include vaccine-induced thrombotic thrombocytopenia, autoimmune hepatitis, myocarditis, and Graves’ disease. We attempt to summarize the diverse autoimmune phenomena reported after COVID-19 vaccination, with an aim to sensitize the medical community so that they can be better equipped in management when confronted with these diseases. This review by no means refutes the potential benefit of COVID-19 vaccination which has consolidated its place in preventing infections and substantially reducing severity and mortality.

Despite their proved efficacy and huge contribution to the health of humankind; vaccines continue to be a source of concern for some individuals around the world. Vaccinations against COVID-19 increased the number of distressed people and intensified their concerns, particularly as the pandemic is still emerging and the populations were encouraged to be vaccinated under various slogans like “back to normal life” and “stop coronavirus”, which is still to be achieved. As fear of vaccination-related adverse events is the main reason for vaccine hesitancy, we viewed autoimmune side effects in particular, though very rare, as the most worrisome aspect of the vaccines. Among others, autoimmune adverse events of the currently circulating COVID-19 vaccines include neurological ones such as Guillain-Barre syndrome, transverse myelitis, and Bell’s palsy. In addition, the newly introduced notion related to COVID-19 vaccines, “vaccine-induced immune thrombotic thrombocytopenia”, and myocarditis, are of importance as well. Reviewing recent medical literature while focusing on the listed autoimmune side effects, demonstrating their rate of occurrence, presenting the cases reported, and their link to the specific type of COVID-19 vaccines formed the aim behind our review. In our paper we illustrate the different vaccine types in current use, their associated autoimmune side effects, as well as focus on the adverse events of the 3 main COVID-19 vaccines (BNT162b2, mRNA-1273, and ChAdOx1). While the rate of such side effects is extremely low, addressing the issue in this manner, in our opinion, is the best strategy for coping with vaccine hesitancy.
